Welcome to the weekly KHQ Super Alert. This week APRA commenced a consultation proposing amendments to CPS 230 for non-traditional service providers, and released its quarterly superannuation statistics. Treasury proposed new legislation which affects the treatment of paid parental leave contributions for superannuation. In addition, the Fair Work Commission proposed to update several modern awards to correctly reflect superannuation arrangements.
APRA – Consultation on CPS 230 changes for non-traditional service providers released
On 10 December 2025, APRA released a consultation on targeted amendments to CPS 230 Operational Risk Management. The proposed amendments are intended to better ‘accommodate the needs of regulated entities that maintain material arrangements with non-traditional service providers (NTSPs)’ (such as government agencies, stock exchanges and settlement platforms).
Specifically, the changes would exempt ‘certain material arrangements with NTSPs from the contractual and service level obligations outlined’ in CPS 230, provided the arrangements meet certain exemption requirements.
The consultation will remain open until 30 January 2026, with the CPS 230 changes proposed to take effect on 1 July 2026.

Treasury – Superannuation and financial services sector initiatives outlined
On 10 December 2025, the Assistant Treasurer and Minister for Financial Services, the Hon Dr Daniel Mulino MP, issued a media release in relation to upcoming Government initiatives that are being undertaken to ‘strengthen consumer protections and improve stability and confidence in the superannuation and financial services sectors’.
The initiatives include:
- hosting a roundtable on the Compensation Scheme of Last Resort (CSLR) to ‘discuss [a] special levy and some of [sic] options on the table for post‑implementation reform’;
- reviewing options for professional indemnity insurance and considering the misuse of insolvency processes; and
- releasing ‘an options paper on the post-implementation reforms of the CSLR’.

APRA – Quarterly superannuation statistics released
On 9 December 2025, APRA released the latest quarterly superannuation industry publication, quarterly superannuation product and quarterly fund-level statistics. These materials contain data on superannuation products, investment options, member demographics.

Treasury – Proposed change to paid parental leave superannuation contribution payments
On 5 December 2025, Treasury invited feedback on the Treasury Laws Amendment Instrument 2025: Minor and technical amendments (Autumn 2026) (Regulations). The purpose of the Regulations is to make minor and technical amendments to Treasury portfolio legislation.
Included in the package is an amendment to the SIS Regulations allowing regulated superannuation funds ‘to accept Paid Parental Superannuation Contributions payments even if the member’s Tax File Number has not been quoted for superannuation purposes to the trustee of the fund’.

Fair Work Commission – Modern awards to updated with standard employer contributions provisions
On 3 December 2025, the Fair Work Commission (Commission) published its decision in the matter of Modern award superannuation clause review 2025. The decision follows an August 2025 statement released by the Commission on key issues relating to modern awards; one being that a number of modern awards do not contain the Commission’s standard employer contributions clause and another being that the names of superannuation funds in modern awards need to be updated or corrected.
The Commission considered several submissions from unions and superannuation trustees, and confirmed its view that various modern awards will be varied to correct the issues it has identified.
