- INTRODUCTION -
With the rapid rise of digital media, incidents of social media impersonation and trademark infringement have become widespread, posing serious risks to brands and individuals. Impersonator accounts misuse trademarks, logos, and trade names to deceive followers, sell counterfeit goods, or damage a brand’s goodwill.
Digital platforms have enabled new forms of trademark infringement like cybersquatting, deceptive keyword advertising, and unauthorized use of marks on social media. Cybersquatting involves registering domain names identical or deceptively similar to well-known trademarks to mislead consumers or extort rightful owners. Similarly, infringers misuse trademarked terms in online ads to divert traffic to counterfeit goods. Fake social media profiles further exploit trademarks, confusing or deceiving consumers and diluting brand value.
In India, the Trade Marks Act, 1999, provides remedies against such infringements, including injunctions, damages, and criminal action. While the Information Technology Act, 2000, doesn’t directly address trademark issues, its provisions on identity theft and impersonation can be applied in online impersonation cases.
Effectively tackling digital trademark infringement requires a combined legal approach under IP and IT laws to protect brand rights and consumer interests.1
