The European Commission is developing a new legislative initiative, the EU Digital Fairness Act (DFA), to modernize EU consumer protection rules online. While no draft of the legislative proposal is available yet, this initiative is expected to focus on tackling certain deceptive online practices (e.g., dark patterns), transparency around influencers’ practices, addressing addictive design and profiling, minor protection online, etc. The DFA is currently in the Commission’s “Have Your Say” consultation phase, making this the right moment for digital businesses to prepare for this new proposal.

In the fashion and luxury industries, Morten has represented clients in parallel import cases involving textile products, as well as in disputes concerning counterfeits, lookalike products, and unfair competition, including misleading statements and comparative advertising.

In addition to his client work, Morten lectured on IP Litigation in the LL.M. program at Bucerius Law School in Hamburg for many years.
